Wrestling is a strenuous, full-contact sport with an inherent and unavoidable risk of serious injury. Please read these terms in full. You are accepting them for yourself and on behalf of the minor participant.
1. Acceptance
By registering a participant, paying a fee, or participating in any Shelton Wrestling Club (the "Club") activity, you agree to be bound by these Terms. If you register a minor, you represent that you are that minor's parent or legal guardian with authority to accept on the minor's behalf.
2. Accuracy of your information
You represent that the information you provide (name, age, weight, medical conditions, emergency contact) is true, current, and complete, and you will tell the Club if it changes. The Club relies on it for safe placement and emergency response and is not responsible for consequences of inaccurate or outdated information.
3. Assumption of risk
You acknowledge that wrestling, conditioning, and travel involve inherent risks that cannot be eliminated, including without limitation bruises, sprains, cuts, dislocations, broken bones, concussion and head injuries, dental and eye injuries, skin and heat conditions, spinal or neck injury, permanent disability, paralysis, and death. You knowingly and voluntarily assume all such risks, known and unknown.
4. Concussion and head injury
Consistent with Washington's Lystedt Law (RCW 28A.600.190), you acknowledge the risks of concussion and head injury. A participant suspected of a concussion during any Club activity will be removed and may not return until evaluated and cleared in writing by a licensed health care provider trained in concussion management. You consent to this removal-and-clearance requirement and assume the risk.
5. Communicable and skin conditions
Wrestling is close-contact and carries a risk of communicable illnesses and skin conditions (including ringworm, impetigo, herpes gladiatorum, staph, and MRSA). You consent to routine skin checks, agree to keep a sick or infected wrestler home, and to obtain clearance before returning to the mat. You knowingly assume this risk.
6. Safe weight management
Rapid weight loss, extreme dieting, and dehydration are dangerous, especially for youth athletes. The Club does not require or endorse extreme weight cutting. You are solely responsible for the participant's nutrition, hydration, and weight-management decisions and release the Released Parties from any claim arising from them.
7. Waiver and release of liability
In consideration of being permitted to participate, you, on behalf of yourself, the participant, and your heirs and assigns, release, waive, discharge, and covenant not to sue the following ("Released Parties"): the Club and its board members, officers, coaches, instructors, volunteers, and members; USA Wrestling and event organizers; the Club's sponsors; the owners and operators of any facility, including the Shelton School District; and Ross Dynamics LLC and any developer, host, or operator of this website. This applies to all claims arising out of participation or use of this website, including claims alleging the negligence of any Released Party, to the fullest extent permitted by Washington law. Wrestling is a vigorous activity and the possibility of injury exists. You give your approval and permission for the participant to take part in the Shelton Wrestling Club, and you waive all claims and legal action, financial or otherwise, against the Club, its elected and appointed officials, coaches, and any volunteer connected with the program, for injuries that might occur during practice, travel, or competition.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of the participant's participation, your breach of these Terms, or any act or omission by you or the participant.
9. Medical authorization, consent to treatment, and insurance
You represent that the participant is physically fit to participate, and the Club recommends a physical examination prior to participation. In the event of injury or illness, you authorize the Club's coaches, volunteers, and event staff to obtain or administer first aid and arrange emergency medical treatment. You further authorize all medical and surgical treatment, x-ray, laboratory, anesthesia, and other medical or hospital procedures that may be performed or prescribed for the participant by a licensed physician or medical facility, and you agree to be solely responsible for all resulting medical costs. It is expected that one parent or guardian stays at practice; if a parent or guardian is not available, you authorize this medical release to apply in your absence. Insurance: children registered with the Club are covered by a secondary insurance carrier provided by USA Wrestling, effective only after the parent's or guardian's own insurance is exhausted, and subject to a deductible. The Club does not provide primary medical or accident insurance.
10. Travel and transportation
You are responsible for the participant's transportation to and from practices, tournaments, and events. Any carpool or ride arranged between families is a private arrangement; the Released Parties do not arrange, provide, or supervise transportation to or from Club activities and are not responsible for it.
11. Code of conduct
Participants, parents, and guests must treat coaches, officials, opponents, teammates, and facilities with respect. The Club may, in its sole discretion, suspend or remove any participant for conduct it deems unsafe or disruptive, without refund.
12. Athlete protection and SafeSport
The Club supports the athlete-protection principles of USA Wrestling and the U.S. Center for SafeSport. Abuse, harassment, bullying, hazing, and misconduct are prohibited and may be reported to the Club's board and, where applicable, to USA Wrestling or the U.S. Center for SafeSport. The Club may take reasonable protective action, including removing a participant, coach, volunteer, or spectator without refund, to safeguard participants.
13. Facility and school district rules
Club activities are held at facilities the Club does not own, including Shelton School District facilities. You and the participant agree to follow all rules of each facility and its owner. A facility owner may limit or withdraw access at its discretion, and the Club is not responsible for a facility owner's decisions, conditions, or acts.
14. Photo and media release
The form above asks whether you permit the Club to use photos and video of the participant. If yes, you grant the Club a royalty-free, perpetual license to use such images for Club promotion. If no, the Club will make reasonable efforts to avoid publishing identifiable images, though it cannot control images captured by third parties at public events.
15. Fees, payments, and refunds
Fees are due as stated at registration and are processed through PayPal, a third party subject to its own terms. Your registration is not complete until the registration fee has been paid in full. Fees are non-refundable except at the Club's sole discretion. USA Wrestling membership is purchased separately, directly from USA Wrestling, and is not collected or refunded by the Club. You agree not to initiate chargebacks for validly rendered services.
16. Cancellation and events beyond our control
The Club need not provide a refund or credit if a practice, event, or season is delayed, shortened, relocated, or cancelled due to weather, loss or unavailability of a facility, school district decisions, illness or public-health measures, low enrollment, or other causes beyond its reasonable control.
17. Website "as is"
This website is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, the Released Parties are not liable for any errors, omissions, downtime, data loss, or damages arising from use of this site. Schedules, fees, and details may change without notice.
18. Website provider and no affiliation
This website is built and hosted by Ross Dynamics LLC (the "Website Provider") under an independent services arrangement. The Website Provider is not the Club and has no involvement with the Club beyond providing website services. It does not organize, run, coach, sponsor, or endorse any Club activity, and has no role in safety, coaching, or finances. Payments are processed by PayPal directly to the Club's account; the Website Provider never receives, holds, or accesses any funds. To the fullest extent permitted by law it has no liability for any injury, loss, or damage arising from Club activities or content, and the release, indemnity, and limitations here apply fully to it.
19. Privacy
Information you submit (parent and participant names, contact and emergency details, and participant weight) is used only to operate the Club and communicate with families. The Club does not sell your information. The Club's Privacy Policy explains this in full and is incorporated into these Terms.
20. Limitation of liability
To the fullest extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages. Their total aggregate liability for any claim will not exceed the total fees you paid to the Club in the twelve months preceding the claim.
21. Governing law and disputes
These Terms are governed by Washington law. Any dispute will first be addressed informally, and any unresolved dispute will be brought exclusively in the state or federal courts located in Mason County, Washington. You waive any right to a jury trial and to participate in any class or representative action.
22. A physical signed release may still be required
Your electronic acceptance does not replace any signed paper release the Club may require. The Club may, and in most cases will, require you to sign a physical (paper) release and waiver before the participant may practice or compete, and may withhold participation until it is received. Your electronic acceptance and any signed paper release are cumulative and read together, each giving the broadest protection to the Released Parties permitted by law; if one is unenforceable the other stays in full effect.
23. Duration of this agreement
This agreement, including the assumption of risk, waiver and release, indemnity, and medical authorization, applies to the current season and any later Club participation, and stays in effect until you revoke it in writing to the Club. Revocation applies only going forward and does not affect participation that already occurred.
24. Changes and entire agreement
The Club may update these Terms by posting a revised version; continued participation constitutes acceptance. If any provision is unenforceable, the rest stays in effect. These Terms are the entire agreement on this subject.
25. Electronic acceptance
By checking the box below and submitting this form, you agree that your electronic acceptance has the same legal effect as a handwritten signature, and that you have read, understood, and voluntarily agreed to all of these Terms, including the assumption of risk, the waiver and release, and the indemnity.
