These terms, including an assumption of risk, a waiver and release of liability, and an indemnity, govern participation in Shelton Wrestling Club and use of this website. By registering or using this site you agree to them.

By accessing this website, registering a participant, paying a fee, or otherwise participating in any Shelton Wrestling Club (the "Club") activity, you ("you," the parent, legal guardian, or adult participant) agree to be bound by these Terms of Service (the "Terms"). If you are registering a minor, you represent that you are that minor's parent or legal guardian with full authority to accept these Terms on the minor's behalf.
You represent that the information you provide at registration, including the participant's name, age, weight, medical conditions, and emergency contact, is true, current, and complete, and you agree to notify the Club promptly of any change. The Club relies on this information to place the participant safely and to respond in an emergency, and the Released Parties are not responsible for consequences arising from inaccurate, incomplete, or outdated information you provide.
You understand and acknowledge that wrestling and related conditioning and travel involve inherent and other risks that cannot be eliminated regardless of the care taken. These risks include, without limitation: bruises, sprains, strains, cuts, dislocations, broken bones, concussion and other head injuries, dental and eye injuries, heat and skin conditions, spinal or neck injury, permanent disability, paralysis, and death. You knowingly and voluntarily assume all such risks, both known and unknown, and accept full responsibility for the participant's participation.
Consistent with Washington's Lystedt Law (RCW 28A.600.190), you acknowledge that you have received and reviewed information about the nature and risk of concussion and head injury, including the danger of continuing to participate after a concussion. If the participant is suspected of having sustained a concussion or head injury during any Club activity, the participant will be removed from participation and may not return until evaluated and cleared in writing by a licensed health care provider trained in the evaluation and management of concussion. You consent to this removal-and-clearance requirement and assume the risks associated with head injury.
Wrestling involves close, repeated physical contact and carries a risk of communicable illnesses and skin conditions, including without limitation ringworm, impetigo, herpes gladiatorum, staph, and MRSA. You consent to routine skin checks, you agree to keep the participant home when the participant has a suspected or diagnosed contagious condition or illness, and you agree to obtain clearance before the participant returns to the mat. You knowingly assume the risk of exposure to communicable conditions inherent in the sport.
You understand that rapid weight loss, extreme dieting, and dehydration are dangerous, particularly for growing youth athletes. The Club does not require, encourage, or endorse extreme weight cutting. You are solely responsible for the participant's nutrition, hydration, and weight-management decisions, and you release the Released Parties from any claim arising out of weight management, dieting, or dehydration.
In consideration of being permitted to participate, you, on behalf of yourself, the participant, and your heirs, executors, and assigns, hereby release, waive, discharge, and covenant not to sue the following ("Released Parties"): the Club and its board members, officers, coaches, instructors, volunteers, and members; USA Wrestling and event organizers; the Club's sponsors; the owners and operators of any practice or event facility, including the Shelton School District; and Ross Dynamics LLC and any developer, host, or operator of this website. This release applies to any and all claims, demands, losses, or damages of any kind arising out of or related to participation in Club activities or use of this website, including claims alleging the negligence of any Released Party, to the fullest extent permitted by Washington law. Wrestling is a vigorous activity and the possibility of injury exists. You give your approval and permission for the participant to take part in the Shelton Wrestling Club, and you waive all claims and legal action, financial or otherwise, against the Club, its elected and appointed officials, coaches, and any volunteer connected with the program, for injuries that might occur during practice, travel, or competition.
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to the participant's participation, your breach of these Terms, or any act or omission by you or the participant.
You represent that the participant is physically fit and has no condition that would prevent safe participation, and the Club recommends a physical examination for the participant prior to participation. In the event of injury or illness, you authorize the Club's coaches, volunteers, and event staff to obtain or administer first aid and to arrange emergency medical treatment. You further authorize all medical and surgical treatment, x-ray, laboratory, anesthesia, and other medical or hospital procedures that may be performed or prescribed for the participant by a licensed physician or medical facility, and you agree to be solely responsible for all resulting medical costs. It is expected that one parent or guardian stays at practice; if a parent or guardian is not available, you authorize this medical release to apply in your absence.
Insurance: children registered with the Shelton Wrestling Club are covered by a secondary insurance carrier provided by USA Wrestling, effective only after the parent's or guardian's own insurance has been exhausted. That USA Wrestling coverage is subject to a deductible. The Club does not provide primary medical or accident insurance for participants.
You are responsible for the participant's transportation to and from practices, tournaments, and events. Any carpool or ride arranged between families is a private arrangement between those families; the Released Parties do not arrange, provide, or supervise transportation to or from Club activities and are not responsible for it. The assumption of risk, waiver, and release in these Terms apply fully to travel associated with Club activities.
Participants, parents, and guests are expected to treat coaches, officials, opponents, teammates, and facilities with respect. The Club may, in its sole discretion, suspend or remove any participant for conduct it deems unsafe, disruptive, or contrary to the spirit of the sport, without refund.
The Club supports the athlete-protection principles of USA Wrestling and the U.S. Center for SafeSport. Abuse, harassment, bullying, hazing, and misconduct of any kind are prohibited. Concerns may be reported to the Club's board and, where applicable, to USA Wrestling or the U.S. Center for SafeSport. You agree that the Club may take reasonable protective action, including removing a participant, coach, volunteer, or spectator without refund, to safeguard the well-being of participants.
Club activities are held at facilities the Club does not own, including facilities of the Shelton School District. You and the participant agree to follow all rules of each facility and its owner while on the premises. A facility owner may limit or withdraw access at its discretion, and the Club is not responsible for the decisions, conditions, or acts of any facility owner.
The registration form asks whether you permit the Club to use photos and video of the participant. If you select yes, you grant the Club a royalty-free, perpetual license to use such images for Club promotion on its website, social media, and printed materials. If you select no, the Club will make reasonable efforts to avoid publishing identifiable images of the participant, though the Club cannot control images captured by third parties at public events.
Registration and other fees are due as stated at the time of registration. Your registration is not complete until the registration fee has been paid in full. Payments are processed through PayPal, a third party subject to its own terms; the Club is not responsible for PayPal's service. Fees are non-refundable except at the Club's sole discretion. USA Wrestling membership is purchased separately, directly from USA Wrestling, and is not collected or refunded by the Club. You agree not to initiate chargebacks for validly rendered services.
The Club is not obligated to provide a refund or credit if a practice, event, or season is delayed, shortened, relocated, or cancelled due to weather, loss or unavailability of a facility, school district decisions, illness or public-health measures, low enrollment, or other causes beyond the Club's reasonable control.
This website is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. To the fullest extent permitted by law, the Released Parties are not liable for any errors, omissions, downtime, data loss, or damages arising from use of this site or reliance on its content. Schedules, fees, and details may change without notice.
This website is designed, built, and hosted by Ross Dynamics LLC (the "Website Provider") for the Club under an independent services arrangement. The Website Provider is not the Club, does not operate the Club, and has no involvement with the Club beyond providing website services. The Website Provider does not organize, run, supervise, coach, sponsor, or endorse any Club practice, event, team, or activity, and has no role in the Club's safety decisions, membership, coaching, or finances. All Club activities, decisions, schedules, and content on this site are supplied by and are the sole responsibility of the Club. Payments are processed by PayPal and go directly to the Club's own account; the Website Provider does not receive, hold, process, or have access to any funds or payment details. To the fullest extent permitted by law, the Website Provider has no liability for any injury, loss, claim, or damage arising from Club activities, from content the Club supplies, or from the acts or omissions of the Club or any participant, and the release, indemnity, and limitations in these Terms apply fully to the Website Provider.
Information you submit (such as parent and participant names, contact and emergency details, and participant weight) is used only to operate the Club and communicate with families. The Club does not sell your information. Our Privacy Policy explains this in full and is incorporated into these Terms.
To the fullest extent permitted by law, in no event will the Released Parties be liable for any indirect, incidental, special, consequential, or punitive damages. The total aggregate liability of the Released Parties for any claim arising out of these Terms or participation will not exceed the total fees you paid to the Club in the twelve months preceding the claim.
These Terms are governed by the laws of the State of Washington, without regard to conflict of law rules. You agree that any dispute will first be addressed through good-faith informal discussion. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Mason County, Washington, and you consent to that venue. You waive any right to a jury trial and to participate in any class or representative action.
Your electronic acceptance of these Terms does not replace any separate written release, waiver, medical authorization, or other form the Club may require. The Club may, and in most cases will, require you to sign a physical (paper) release and waiver before the participant is permitted to practice or compete, and the Club may withhold participation until that signed release is received. Your electronic acceptance and any signed written release you provide are intended to be read together and to be cumulative, each giving the broadest protection to the Released Parties permitted by law; neither limits the other, and if one is held unenforceable the other remains in full effect.
These Terms, including the assumption of risk, the waiver and release, the indemnity, and the medical authorization, apply to the current season and to any subsequent Club participation by the participant, and remain in effect until you revoke them in writing delivered to the Club. Any revocation applies only going forward and does not affect participation that has already occurred.
The Club may update these Terms at any time by posting a revised version here; continued participation or use constitutes acceptance. If any provision is held unenforceable, the remaining provisions stay in full effect, and the unenforceable provision will be enforced to the maximum extent permitted. These Terms are the entire agreement between you and the Club regarding this subject and supersede prior understandings.
By checking the acceptance box and submitting the registration form, or by using this website, you agree that your electronic acceptance has the same legal effect as a handwritten signature, and that you have read, understood, and voluntarily agreed to all of these Terms, including the assumption of risk, the waiver and release, and the indemnity above.
